Important notice: Please note the additional Terms & Conditions that apply while the West Australian State of Emergency Directions for the COVID-19 pandemic are in place. The additions are to be read in conjunction with West Australian Opera’s General Terms & Conditions.

Do not attend a performance if you are unwell

Please do not be attend a live performance if you are unwell. As an interim COVID-19 measure if you are unwell, please contact [email protected] prior to the performance to discuss your options with us. 

Contact tracing data collection

We are required to maintain attendance records of patrons for contact tracing purposes, and request the contact details for all patrons when you purchase your tickets. Please inform us if the contact details for you or your guest(s) change after booking your tickets, including if your group includes different people. The contact information you provide will only be used for contact tracing purposes if necessary, is stored securely and will be deleted 28 days after the State of Emergency Directions expires.

Health and hygiene

West Australian Opera performs at many venues, all of whom have increased their cleaning regimes. There will be hand sanitizer available for you to use at all West Australian Opera performances.

Physical distancing

Please ensure you are practicing physical distancing with our staff and other patrons by keeping a distance of 1.5 metres and that you use the designated queuing spots on the floor when lining up at the performance venue. Please listen to any direction given by our staff.

Venue Requirements
Please note that depending on the event you are purchasing tickets for you may be purchasing tickets from West Australian Opera or Perth Theatre Trust.

Proof of vaccination and mask wearing are a requirement for entry to for Perth Theatre Trust venues such as His Majesty's Theatre and Perth Concert Hall ticketed venues such as Government House Ballroom. 

General Terms and Conditions
Application of General Terms and Conditions

The sale of tickets for an Event and attendance at an Event are subject to these General Terms and Conditions as well as any specific terms and conditions notified at the time of ticket sale.

“Event” means a concert, show or other performance that is arranged by West Australian Opera.

“You” means the person acquiring a ticket or seeking to attend an Event and “we” means West Australian Opera.

By acquiring a ticket for an Event and/or seeking to attend an Event, you agree to these General Terms and Conditions.

By purchasing a ticket on behalf of someone else, you undertake to inform them of these General Terms and Conditions and any other terms and conditions notified at the time of sale.

These General Terms and Conditions also apply to tickets issued by an authorised ticket seller (if any). To the extent of any inconsistency, these General Terms and Conditions, and any other conditions of sale relating to the specific Event notified at the time of sale, will prevail.

Resale Prohibited

You agree not to re-sell any tickets for profit.

Tickets must be purchased from an authorised ticket seller and must not be included in packages or used in advertising unless authorised by us in writing.

Tickets purchased from Ticketmaster Resale, Viagogo, Ticketbis, eBay, Gumtree, Tickets Australia or any other unauthorised re-seller may be cancelled without notice and/or the holder may be refused admission to the Event.

Other Terms and Conditions of Sale

We may impose other terms and conditions of sale in relation to specific Events, in which case you will be notified of these at the time of sale, including on our website with the information relating to the specific Event.

We may impose a maximum ticket limit to specific Events. Unless otherwise specified, the maximum number specified applies to the Event or season overall, not to each performance.

West Australian Opera reserves the right to change any element of its sales structure, including but not limited to reserves and pricing, at any time and without notice. Pricing for any event or product sold through West Australian Opera, may be  subject to demand based pricing. This may see prices increase or decrease at any time during a sales period for any given event or product. These changes may occur without notice.

Refunds

We will not be responsible for refunding tickets purchased from unauthorised re-sellers.

Otherwise, you are entitled to a refund if we cancel an Event or reschedule it to a time more than 2 hours earlier or later than originally programmed and you cannot or do not wish to attend the rescheduled Event. You are also entitled to a refund if we issue a ticket to you by mistake and we are unable to provide you with the Event in question.

If you believe an Event you have attended was not provided substantially as advertised, we will give reasonable consideration to your request for a refund. However, we reserve the right not to provide a refund:

(a)          merely because you did not enjoy the Event, performance or venue, you arrived late or did not attend;

(b)          if you were refused entry or removed due to your breach of these General Terms and Conditions

(c)           if, despite our reasonable diligence, the cause was outside our control.

If you believe you are entitled to a refund you should apply within five business days after the Event’s scheduled commencement. You may enquire about refunds here. If you do not seek a refund within a reasonable timeframe we may not provide you with the requested refund, unless required by law.

Any refund payable will be made to the original purchaser, and when practicable to the original form of payment used to purchase the ticket.

We will not be responsible for any expenses incurred or to be incurred by you, for example travel, car parking, child care, accommodation or other goods or services, even if the Event is cancelled. You should consider whether insurance is appropriate for your circumstances.

Changes

While we endeavour to keep ticket-holders informed, details may change sometimes with little or no notice. For example, artists or other participants may be added, withdrawn or substituted or the venue may change.

Despite any seat number on your ticket, we do not guarantee you any particular seat. If we need to allocate a different seat to you for operational reasons, including a change of venue, we will use reasonable endeavours to ensure it is in a location of comparable value to the seat number on your ticket.

We make every effort to ensure pricing is correct but we reserve any rights we may have to correct genuine errors.

Refusal of Admission

We may refuse entry to an Event or have you removed from the venue on valid grounds, including if:

(a)          you fail to comply with these General Terms and Conditions or the venue’s Conditions of Entry;

(b)          we have not received payment for your ticket or you are unable to produce a ticket;

(c)           you are intoxicated or you behave in a threatening, disruptive or offensive manner;

(d)          you interfere unreasonably with another visitor’s enjoyment of the Event or venue or with our staff carrying out their functions; or

(e)          as specified elsewhere in these General Terms and Conditions.

We may need to refuse admission for safety or security reasons, in which case we will refund your ticket if it was purchased in accordance with these General Terms and Conditions.

Unless otherwise specified, we do not provide supervision of children. All children requiring supervision must be accompanied by a supervising adult at all times and may be refused admission or attendance if not accompanied by a supervising adult.

Latecomers may be admitted to a performance during a suitable break.

Liability

You should make your own further inquiries before deciding whether an Event is suitable.

You are responsible for your personal possessions such as bags, mobile phones and other items you carry with you.

Our liability to you in relation to tickets is limited to the obligations specified in these General Terms and Conditions and our obligations under applicable laws and the Live Performance Australia Ticketing Code of Practice – Consumer Code.

The Australian Consumer Law provides certain statutory guarantees for consumers which cannot be excluded, for example that services will be provided with due care and skill. Nothing in these General Terms and Conditions modifies or excludes those guarantees.

West Australian Opera Privacy Policy

West Australian Opera recognises the importance of protecting your privacy and your right to keep your personal information private. In the course of our functions and activities we use the information we collect about you to process donations, to send you information and to provide a more personalised service.

What information we collect
The kind of information we generally collect and hold about a person is their name, email address, postal address and other contact details. Information relevant to your relationship with us may also be collected, such as transaction details, indicated seating and event type preferences and details of donations and other support provided to the organisation.

Collection of Personal Information
West Australian Opera will collect information directly, or via third party ticket sellers or service provider acting on West Australian Opera’s behalf, from the individual when they purchase tickets, subscribe, join our mailing lists or make a donation.

When You Become a Donor
We ask you to provide your full name and contact details including address, day and evening telephone numbers and email address.  If you are paying your donation by credit card, you are required to provide your credit card name, number, expiry date & CSV. The online donation process commences at WAO’s website and is completed through a secured server.

When You Sign Up for our Mailing List
When you sign up for the WAO e-newsletter we ask you to provide your name and email address. You can unsubscribe from our e-newsletter or be taken off our general mailing database at any time by contacting West Australian Opera and requesting your details be removed.

When You Book an Education Program
We ask you to provide your name and position, along with the name of your school and details relating to the group/s and times of year for which you wish to book. We use this information to process your booking and contact you to check, alter or confirm details of your participation in the education program you have chosen.

Purchasing a Ticket to West Australian Opera
West Australian Opera’s tickets are sold through Perth Theatre Trust. Please see Perth Theatre Trust privacy policy at https://www.ptt.wa.gov.au/privacy/  for more information. West Australian Opera collects purchaser information from Perth Theatre Trust. The usage of this information is outlined below.

Usage
West Australian Opera may use information that we collect to provide our patrons with information that they may find useful. This includes, but is not limited to:

  • Marketing Information
  • Special Offers
  • Season Brochures

West Australian Opera will only use personal information in the promotion of events that we consider likely to be of interest to our patrons.

Parties who will have access to personal information

Generally, your personal information will only be accessed by West Australian Opera staff when and where it is appropriate or necessary. However, your personal information may also be accessed, from time to time, by various organisations, including:

  • Barking Gecko Theatre Company;
  • Black Swan State Theatre Company;
  • Co3 Contemporary Dance Australia;
  • Perth Festival;
  • West Australian Ballet;
  • Perth Theatre Trust;
  • Western Australian Museum;
  • Yirra Yaakin Theatre Company;
  • Perth Theatre Trust contractors;
  • Perth Theatre Trust project partners; and
  • Perth Theatre Trust suppliers.

Where a party, other than an employee or officer of West Australian Opera, has access to the personal information of individuals, they will be required to comply with the Privacy Act 1988 (Cth) (Privacy Act), the Privacy Amendments (Notifiable Data Breaches) Act 2017 (Cth) and the Australian Privacy Principles and, where appropriate, to enter into privacy agreements with West Australian Opera.

Storage
Information collected is stored electronically and secured on a server accessible only by password. Information is only accessible to West Australian Opera staff and approved IT service providers. West Australian Opera takes all reasonable steps to ensure the security of personal data we hold from risks such as loss or unauthorised access, destruction, use, modification or disclosure of data.

Disclosure
West Australian Opera understands the importance of keeping your information private, and only discloses your personal information to third parties in certain circumstances.

  • Service providers that assist with certain functions, performances, events and activities, in which case we impose appropriate privacy obligations on the service provider (e.g. we may use mailing houses to send information and materials to you)
  • Government and regulatory authorities and other organisations, as required or authorised by law
  • A service provider for the purpose of sending you information from our sponsors or other arts companies
  • Market research company for the purpose of understanding our market
